Child Support Hearing

A child support hearing was held in Atlanta Georgia in late January, in the wake of the brutal murder of the child’s mother in the spring of 2009, said a New York Family Lawyer with knowledge of the case.

The boy’s parents, who the New York Family Lawyer said were involved in a protracted custody dispute, were making a routine custody exchange in the parking lot of a Target chain store in Snellville, Georgia in April of 2009 when the murder occurred. Investigators said that the boy was present at the scene, and hid in his mother’s parked car at the time of the incident.

Present at the child support hearing, which took place on Monday, January the 31st, were the child’s father, as well as the parents of the child’s deceased mother. This hearing comes close on the heels of a custody trial for the boy, which took place in June of 2010 and awarded custody of the boy to the mother’s parents. It is not known why custody was not awarded to the father. In Manhattan and Queens, the mother is usually awarded custody.

Investigators in the murder case identified the mother-in-law as the primary suspect, and arrested her on charges related to the incident; the N York Family Lawyer we spoke with was unable to say specifically what charges she faced.

Additional details in the case are forthcoming. A crime scene report was not available for the writing of this article, and many of the details are being withheld by the investigators, who cite the ongoing investigation of the murder.

Missing boy found after a two-month search

An 11-year-old boy, who had been missing for two months according to his mother, was finally found with his father after a long search by authorities.
A N York Family Attorney said the boy had been visiting his father on his usual weekend when his father took him for fear of being arrested. The mother and father have had joint custody since their divorce a year ago.
The New York Family Lawyer went on to explain the man had allegedly not been following all of his divorce stipulations. On the weekend he had his son, he learned there was a warrant out for his arrest. The man reportedly sped away in his car with the boy when he saw a deputy nearby.
“He wasn’t holding up his end of the deal so I reported him,” the mother said. “I never thought he would do something like this, though.” “Obviously I’m elated,” she added. “I’ve been hoping for this every day. Today is the best day ever.”
Reports indicate a judge had issued a civil warrant for the man’s arrest not long before the kidnapping. A NY Family Lawyer said that now the man’s charges are much more serious. “He is being charged for interfering with the custody of a child, which is a third degree felony.”
While the boy was missing, the man was placed on the Southwest Florida Crime Stoppers’ 10 Most Wanted list. According to court reports, the couple had been struggling for many years before filing for divorce. The husband allegedly had a history of conflict with his fellow coworkers and his wife.
During their divorce, the families were surprised when joint custody was awarded. One family member, who preferred to stay anonymous said, “This is probably the best thing that could have happened. Now he can’t have the boy every other weekend anymore and will hopefully lose custody. We’re all hoping for her sake (the mom) that’s what happens.”

The boy has been placed under observation with a hospital and will be undergoing counseling for the next few months. Jaime Pressly splits from husband, a New York Family Lawyer says.

Jaime Pressly has not had a great year so far.

It has only been three weeks since Pressly, 33, was pulled over under the suspicion of drinking and driving. Now, many close friends of Pressly say she and her husband, Simran Singh, are getting a divorce. Singh is an entertainment lawyer.

One source told UsMagazine that “They are done.” The couple was married September 2009 in Malibu. The small ceremony was with some of the couple’s closest friends. The couple have has been married for almost two years.

“It’s over,” another source said. “I don’t think they have officially filed anything yet though.” The sources were not able to give a reason for the break up, a New York Family Lawyer added.

Pressly, an actress who plays in the television show “My Name is Earl,” has a son name Dezi. Dezi is her three-year-old son. Singh is not the biological father of Dezi. Pressly’s ex-fiancé, Eric Cubiche, is Dezi’s father. Divorce cases in Brooklyn and Long Island are often decided by the presiding judges.

The source said that Pressly is more concerned about how Dezi will be affected by the split. “She doesn’t want to confuse him. Her baby is her top priority. She is a strong girl though and she will come out of this fine.” A child custody battle would add another dimension to the divorce if Singh did ask for custody. It is unclear if Singh adopted Dezi when the couple was married.

Other reports state that Pressly’s ex-fiancé may be trying to get custody of Dezi after this occurrence. Three weeks ago, Pressly was arrested under the notion of DUI, a New York City Family Lawyer reported. It is unclear if Cubiche will actually file for child custody.

Man Accused of Killing Wife Over Custody

A man who is accused of killing his wife and her boyfriend was attending his child’s custody hearing on Tuesday. The child is now 13 years old and the court case will decide where she should live explains a New York Family Lawyer. This is a very unusual case as most custody cases occur due to divorce.

The father is said to of killed his wife and her boyfriend. It is said that the man broke down in court when he was questioned. In Manhattan and Queens, lawyers deal with these cases many times.

The court looked at some of the information surrounding the murder investigation when making the decision of custody. The court was told that the young girl was in the shower when she heard gun shots. The 13 year old girl was at the hearing but she did not enter the court room. Perhaps this was because it was too upsetting for her to see her father, and murderer of her mother.

It has been decided by the court that the 13 year old girl will continue living with her sister, according to NY Family Lawyer. In most conventional custody hearings the court will ask both parents. In this case, the state and the father were asked. Neither of the lawyers on either side had any objections when asked for their opinion.

It was decided that the sisters home was a stable environment and suitable for raising a child in. The court witnessed the man break down when he was questioned. The judge needed to stop the hearing once because he started to cry so loudly. It is thought that the man does show remorse for his actions.

The girl seems emotionally balanced and enjoying living in a comfortable environment. She apparently wants to be a police officer when she grows up. Hopefully this girl will be able to turn her life around and study to become a Police Officer in the future.

A Judge ordered the father to stay in jail and away from his daughter. He said that he would not be awarded a bond and that he had destroyed his child’s life forever.
