Court Confirms Order for Protection

The petitioner and respondent in this case is Jennifer M. The respondent and appellant of the case is Derek J. This case is being heard in the Appellate Division of the Supreme Court of the State of New York.

A New York Family Lawyer said the order that is being appealed in this case was made in the Family Court of Bronx County by Judge Alma Cordova. The order was entered on or around the 24th of May, 2010 and granted the respondent father with supervised visitation rights with the child of the couple. A five year order of protection was issued against him.

Court Discussion

The Family Court of Bronx County found that the respondent had committed assault in the second and third degrees, harassment in the first and second degrees, disorderly conduct, and menacing in the second degree. For this reason the Family Court had jurisdiction over the family offense proceeding and issued the protection order properly.

Repeated domestic violence acts were committed by the respondent towards the petitioner and the child. A New York Custody Lawyer said these offenses were proved by substantial evidence. This evidence showed a substantial basis for the need of supervised visitation with the respondent and the child.

Court Decision

When reviewing the facts of the case it is found that the previous order was correctly made. A Nassau County Family Lawyer said the Bronx County Family Court was correct in their decision to provide the petitioner with a five year protection order and to order supervised visitation between the father and son. For this reason, the previous order is affirmed.
