More Couples Divorcing as Recession Eases

There has been an increase in the number of divorce cases in recent months. One possible reason for this happening is because of the recession becoming much less serious. It’s thought that several people who were in troubled marriages simply waited until the financial crises have eased slightly. People start to feel more comfortable in their abilities and future and so will start divorcing.

A previous employee of Disney World decided that it was the right time for her to divorce, and leave her partner. She explained to a Suffolk County Divorce Lawyer that she had been in a troubled marriage for several years before deciding to leave.

It has been explained that during the real estate boom a couple of years ago, her husband took some of the equity from their home to buy apartment units. The apartment units were bought through the spouses name to benefit from a better credit rating, it was explained. However, due to the financial crisis many of these apartments remained empty. This meant that unpaid rent notices and loan payments were quickly becoming out of control. The couple had no choice other than declare bankruptcy.

Many people in troubled marriages must have been waiting for the financial crisis to ease. When people start to feel more comfortable then they will then decide whether or not they want to divorce.

The facts have actually proved that this theory is correct. The figures obtained say that the number of family law or divorce cases in Orlando have increased by 12% in 2010. And in 2008, the number of divorces in the state had fallen by 5%. This does suggest that people are more concerned with surviving in lean times than they are divorcing and getting out of troubled relationships. Many people think that this is actually a little strange. One of the leading causes of divorce is actually because of financial stress. During the recession it would be much more likely that this stress would break up marriages, however this is not the case.

Another Hollywood Marriage Bites the Dust

Friday, January the 28st 2011 marked the end of a marriage made in Hollywood heaven, said a New York Family Lawyer with inside information. Actress Eva Longoria and her NBA superstar husband Tony Parker terminated their three-year marriage in a courtroom in Texas late last week.

Although anyone who has been following the media storm over the last few weeks which has surrounded the couple knows that the split occurred as a result of Parker’s now infamous infidelity, the divorce petition Longoria submitted to the court flagged irreconcilable differences as the reason for the split. In Long Island and Westchester County, divorce cases are handled in a similar way.

Ironically, the state that brought them together was also the state where the storybook marriage came to a dramatic close following Parker’s extramarital tryst. Longoria, who is originally from the Texas town of Corpus Christie, fell for Parker, who is one of the star players for the San Antonio Spurs. On the mend after her painful divorce from Tyler Christopher (of General Hospital fame) in 2004, she fell for Parker. They were married midyear in 2007. The New York Family Lawyer we spoke with said it is not uncommon in the wake of a divorce for unhitched couples to go back to their roots to seek comfort and safety; likely one of the reasons Longoria became involved with Parker.

Fortunately, the couple has the foresight to sign a prenuptial agreement, so the division of assets leaves little to be decided- although Longoria did petition the court for spousal support.

Jaime Pressly splits from husband, a New York Family Lawyer says.

Jaime Pressly has not had a great year so far.

It has only been three weeks since Pressly, 33, was pulled over under the suspicion of drinking and driving. Now, many close friends of Pressly say she and her husband, Simran Singh, are getting a divorce. Singh is an entertainment lawyer.

One source told UsMagazine that “They are done.” The couple was married September 2009 in Malibu. The small ceremony was with some of the couple’s closest friends. The couple have has been married for almost two years.

“It’s over,” another source said. “I don’t think they have officially filed anything yet though.” The sources were not able to give a reason for the break up, a New York Family Lawyer added.

Pressly, an actress who plays in the television show “My Name is Earl,” has a son name Dezi. Dezi is her three-year-old son. Singh is not the biological father of Dezi. Pressly’s ex-fiancé, Eric Cubiche, is Dezi’s father. Divorce cases in Brooklyn and Long Island are often decided by the presiding judges.

The source said that Pressly is more concerned about how Dezi will be affected by the split. “She doesn’t want to confuse him. Her baby is her top priority. She is a strong girl though and she will come out of this fine.” A child custody battle would add another dimension to the divorce if Singh did ask for custody. It is unclear if Singh adopted Dezi when the couple was married.

Other reports state that Pressly’s ex-fiancé may be trying to get custody of Dezi after this occurrence. Three weeks ago, Pressly was arrested under the notion of DUI, a New York City Family Lawyer reported. It is unclear if Cubiche will actually file for child custody.

Fifteen Pound Four-Year-Old Girl Found Dead, According to New York City Family Lawyer

A four-year-old girl, severely malnourished, was found dead in a dirty Brooklyn apartment. There was evidence that she had been tied to her bed, New York Family Lawyers have learned.
The little girl weighed a scant 15 pounds. The bruises and marks on her ankles were indications that she had been tied with twine, police sources told a New York Family Lawyer. The cause of the child’s death is currently unknown, leaving police unsure if the case is one of horrific neglect or merely the tragic end of a child who had never been very healthy to begin with.
The Administration for Children’s Services had hired an outside agency to help the family, who was having trouble caring for the girl, but according to a New York Family Lawyer, the organization had failed to live up to its obligations. “My wife is a wonderful mother. I’ve never seen her hurt her kids,” said the girl’s father, 30, who is currently separated. “It’s hard for me to believe she would do anything like that.”
The girl was born prematurely, weighing not much more than a pound. She had spent almost her entirely life in hospitals. “She was beautiful, smart, and very playful,” the father said. He also said he knew nothing about his daughter being tied down.

Court Rules Against Gay Divorce in Texas

In what may seem to be a strange twist of legal interpretation, a Texas court of appeals has ruled that gay couples who were legally married in other states, where gay marriage is legal, may not divorce in Texas – a state where gay marriage is not recognized by the law, according to a New York Family Lawyer.
The 5th Texas Court of Appeleas made the ruling, which stated that a Dallas judge did not have jurisdiction to grant a divorce to two men who lived in Dallas, but were married in Massachusetts, said a New York Family Lawyer.
The same judge also made the ruling that Texas could not limit marriage to being only between a man and a woman. The appeals court disagreed, saying that the Texas laws against same-sex marriage do not violate the Constitution.
The Dallas couple, who are only known by aliases in their court filings, were married in 2006 in Massachusetts, but were separated two years later. The attorney for one of the men told a New York Family Lawyer they had not yet decided if they were going to make an appeal to the Texas Supreme Court.

Lindsey Lohan’s Father Wants Conservatorship

Michael Lohan, father of Lindsey Lohan, recently announced he wants financial control of the assets of both of his daughters, a move which the girls’ mother firmly opposes, sources told a New York Family Lawyer. According to Mr. Lohan, he feels compelled to take financial control of his daughters, Lindsay and Ali, because they are out of control and need his help.
Unfortunately, Mr. Lohan has spent his own time in both rehab and jail.
